    Senator Sands and Bennett,

    Missoula County opposes SB 277: Generally revising laws related to state's rights, up for hearing tomorrow morning, in the Senate Judiciary Committee.

    SB 277 would significantly hamstring local government responding to an emergency. Pursuant to this law, if the president declared a national emergency, and the Montana attorney general determined that it was an unconstitutional declaration of emergency by the president, then local governments could not utilize federal funds to respond to the emergency unless the federal congress also declared an emergency.

    As we have witnessed during the pandemic, federal funds play a vital role in the survival of local economy during unknown circumstances.

    Please oppose SB 277.

    Missoula County continues to oppose SB 277: Generally revising laws related to state's rights, as amended, scheduled for second reading today on the House floor.

    SB 277 would significantly hamstring local government responding to an emergency. Pursuant to this law, if the president declared a national emergency, and the Montana attorney general determined that it was an unconstitutional declaration of emergency by the president, then local governments could not utilize federal funds to respond to the emergency unless the federal congress also declared an emergency.
