Remove prohibitions on county board of appeals re: property use and zoning

    Missoula County opposes HB 496, Remove prohibitions on county board of appeals, on the House floor today. As written, HB 496 would require that local governments, when addressing pressing public needs, comply with local zoning ordinances instead of holding a hearing with the zoning board. In Missoula County and around the state, local governments strive to be good neighbors by complying with zoning laws whenever possible, but local governments also often perform functions that local zoning regulations do not encompass. Two recent examples in Missoula County are the revitalization of the Missoula County Fairgrounds and the Missoula County Elections Center. Neither the fairgrounds nor the elections centers are functions found in the private sector, and they simply don’t match the needs of residential and commercial zoning in the area. The zoning board hearing ensures that we receive input from neighbors and that we work hard to incorporate zoning regulations when possible, but still allows these projects that benefit the community as a whole to move forward.

As written, HB 496 would require that local governments, when addressing pressing public needs, comply with local zoning ordinances instead of holding a hearing with the zoning board.
