Allow for a referendum to terminate a county zoning district

  1. Representatives,

    Missoula County asks no amendments be made to SB 294: Allow for a referendum to terminate a county zoning district, up for second reading on the House floor this morning. Though we remain neutral on the bill currently, if the amendment were made, counties would be prevented from adopting minimum lot sizes (one of the key components of zoning) further than three miles from a municipality unless the counties have adopted a land use map in the growth policy, restricting counties’ abilities to exercise zoning authority.

    Please oppose amendments being sought on SB 294.

    Missoula County strongly opposes the amendments made to SB 294: Allow for a referendum to terminate a county zoning district, up for third reading on the House floor today. By adding “and” between new section 3 (1) (a) & (b) as well as the language below, this bill appears to be on the threshold of preempting residential zoning three miles outside of an incorporated area to what would be allowed under sanitation review, regardless of planning that may have been done to manage growth and protect public health and safety. This will seriously undermine all county land use planning efforts three miles outside the city of Missoula.

    Missoula County opposes the following amendment:

    “(2) Any restriction on lot size for a parcel located in an area zoned for residential use and located more than 3 miles outside of the limits of an incorporated municipality is subject only to on-site conditions based on requirements for water and sewer established and implemented by the department of environmental quality. A board of county commissioners may not implement more stringent lot size restrictions than those imposed by the department of environmental quality.”

    Please oppose the amendment to SB 294.
