SB 211

 LC0882

Steve Fitzpatrick (R) SD 10

Revise local subdivision review criteria regarding agriculture

Comments

  1. Senators Boldman and Morigeau,

Missoula County opposes SB 211: Revise local subdivision review criteria regarding agriculture, up for hearing this afternoon in the Senate Local Government Committee. Restricting agricultural impacts review to adjacent agricultural operations fails to recognize that agricultural operations are maintained on larger scales and not necessarily a lot-by-lot basis. The legislature has found that soils of the state of Montana are one of its most basic and precious natural resources and that detailed capabilities and adaptability is essential for: (a) making wise land use decisions; and (b) preparing plans for cities, towns, counties, planning boards, farmers, foresters, industrial developers and residential developers (76-11-202(1)(a-b), MCA). It is therefore a mistake to exclude evaluation of soils as part of impacts to agriculture. Soil quality can clarify which areas are more appropriate for subdivision development versus those areas that are more appropriate for cultivation.

    Please oppose SB 211.
